Legislation Update 

The private rented sector in England is undergoing some of the most significant legislative changes in decades — changes that will affect how tenancies work for both landlords and tenants. The Renters’ Rights Act 2025 introduces a new legal framework that starts to take effect from 1 May 2026 and continues in phases over the next few years.

From May 2026, key reforms include:

  • No more Section 21 ‘no-fault’ evictions — landlords will no longer be able to end a tenancy without a specific legally valid reason. Instead, under a section 8, evictions must be based on defined grounds such as serious rent arrears or sale of the property. 

  • Assured periodic tenancies become the norm, replacing fixed-term assured shorthold tenancies. This gives tenants more stability while still allowing landlords to regain possession for legitimate reasons. 

  • Rent increases can only happen once a year and must follow a formal statutory process. 

  • More than one month’s rent in advance will be banned, helping to create a fairer letting process. 

Further phases of reform will introduce a national landlord and property database, a Landlord Ombudsman scheme, and minimum property and safety standards for the private rented sector.
